Padable Ltd Terms and Conditions

1. PRODUCT SPECIFICATIONS
1.1 Padable Ltd (We) take all care and attention to ensure that the technical information and advice is accurate but we do not warrant the accuracy thereof and the customer (you) relies on the same at their own risk.
1.2 Some supplied tables are made from natural wood which may differ in colour and grain from any table images available. Wood colours may fade with age and exposure to sunlight.
1.3 Leather products are made from natural leather and consequently they may not be completely uniform in appearance. Only the finest leather is used but it may show natural marks on the hide. Some leathers will mellow with age and exposure to sunlight and heat.
1.4 Colours of fabrics in images are reproduced with all care and attention taken by Padable Ltd to ensure as accurate a representation as possible. Fabrics have different colourings dependent on lighting and fabric pile and we strongly recommend that you take advantage of our free sample service before order confirmation.
1.5 All of the products manufactured by Padable Ltd meet the UK Furniture and Furnishings (Fire) (Safety) Regulations 1988 (as ammended 1989, 1993 and 2010) for domestic use.
1.6 Standard products are not warranted for commercial use. When Padable Ltd has agreed to provide products suitable for commercial use appropriate documentation will be supplied to support this condition.
1.7 We cannot be held responsible for the quality of any fabric supplied by customers. To meet the Furniture & Furnishings (Fire)(Safety) Regulations Padable Ltd must ensure that thefootrest covering fabric is match resistant and where necessary and where suitable Padable Ltd will arrange for fabric treatment to achieve match resistance. This process requires an additional half metre of fabric for testing which must be supplied by the customer.
1.8 Padable Ltd reserve the right to cancel any order where we believe that we are or will be unable to meet any applicable laws.
2. MEASUREMENTS
2.1 Padable made to measure footrests are made for the table measurements supplied by the customer. Padable takes no responsibility for any fitting problems due to incorrect or inaccurate measurements supplied.
2.2 Cushion sizes refer to the size of the cushion cover prior to filling. The finished size once filled will be slightly less than the stated size.
2.3 The customer is responsible for ensuring that any table ordered will pass through any planned access into your room.
2.4 The measurements of tables listed on our website are as accurate as possible but are based on manufacturer supplied figures.
3. PRICES
3.1 All prices include VAT which is applicable to all of our products and costs, at the prevailing rate.
4. ORDERING & PAYMENT
4.1 Customers placing an order from our website or by phone will receive by post a sample of any fabric in the order, further details of table measuring, a copy of Padable Ltd Terms and Conditions and notification of the expected date of order confirmation.
4.2 The Customer will then be contacted by Padable Ltd on the order confirmation date and the Customer will be required to confirm final fabric choice and if applicable, exact table measurements.
4.3 Full payment is due at order confirmation. Manufacture of your order will only commence after full payment has been received.
4.4 Payment may be made by credit or debit card (we do not accept American Express) over the phone, by internet bank payment or by cheque. In the event of payment by cheque, delivery of the goods will only take place after payment has cleared.
4.5 All goods remain the property of Padable Ltd until payment has been received.
4.6 We reserve the right to refuse any order placed by you.
5. DELIVERY
5.1 All delivery prices quoted online are based on you having a permanent address on the UK mainland. Charges for delivery to any other address will be agreed when ordering.
5.2 We will normally deliver your order within 7 days of order confirmation and payment. Table orders may be subject to further delays in sourcing from our suppliers. Any longer expected delivery delays will be notified at order confirmation.
5.3 You are responsible for providing a safe means of access from the public highway to the place of delivery. If the carriers delivery staff consider that access is unsafe then they may refuse to deliver the goods until safe access is provided.
5.4 Delivery will be subject to the conditions of the carrier being used.
5.5 In the event of the carrier returning the item(s) after being unable to complete the delivery then a re-delivery charge in line with our direct costs will be levied.
5.7 If our carriers accidentally damage goods in the course of delivery our liability for that damage is limited to the repair, replacement or refund of the goods or the value thereof.
5.8 We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Padable Ltd or any reasonable rescheduling of delivery.
5.9 If items are received damaged please contact us immediately and we will rectify the problems as soon as possible.
6. RETURNS, REFUNDS AND RIGHT TO CANCEL
6.1 Customers may cancel or modify an order at any time up to and including the order confirmation at no charge.
6.2 Due to the nature of our products, all of our products are considered to be "goods made to the consumer’s specifications" under the terms of the Distance Selling Regulations (2000). Accordingly products supplied by Padable Ltd are not covered by the Distance Selling Regulations Right to Cancel conditions.
6.3 Padable Ltd will only accept returns due to manufacturing defect or accidental damage in the course of delivery. Refund or replacement will not be supplied for any other reasons including suitability, personal taste or incorrect fit due to incorrect supplied measurements.
6.4 Cancellation of the order by the customer will not be accepted after order confirmation.
6.5 These conditions do not affect your statutory rights.
6.6 If Padable Ltd deliver incorrect or damaged goods, or in the event that you discover any defect in the goods for which compensation or other remedy is required, the defect must be reported within 7 days of the receipt by contacting us in writing. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided.
6.7 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves. This does not affect your statutory rights.
6.8 Padable Ltd will not be liable for any damage or loss resulting from repairs attempted by you or third parties.
7. DATA PROTECTION
7.1 Padable Ltd will process your data in accordance with the Data Protection Act 1998.
7.2 Padable Ltd will retain your contact details and the products which we have supplied to you to comply with the UK Furniture and Furnishings (Fire) (Safety) Regulations 1988 (as ammended 1989, 1993 and 2010). This data will be securely stored for a minimum of 5 years to maintain traceability of all upholstery materials and will only be used in the unlikely event of issuance of a product safety notice.
7.3 No customer data will be supplied to any third parties unless Padable Ltd is legally obligated to make such disclosures.
8. APPLICABLE LAW
8.1 This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
9. GUARANTEES AND CLAIM PROCEDURE
9.1 Padable produced footrests and cushions carry a 2-year guarantee. The tables we supply carry a 1 year guarantee.
9.2 This guarantee does not cover wear and tear; neglect; abuse or misuse of your goods; loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage or loss or damage caused by a third party.
9.3 In the event of a claim under guarantee occurring, please contact us with full details of the problem.
9.4 We will arrange to repair or replace the defective or incorrect item free of charge. Should a fabric finish no longer be available then it will be replaced with one that most closely matches it.
9.5 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves. This does not affect your statutory rights.
